IMPORTANT: Read Before Ordering!

TERMS OF PAYMENT:

Open account (on known or approved credit ratings) two percent (2%) ten(10) days, net thirty (30) days from date of shipment. On C.O.D. shipments, we require a 1/3 cash advance with the balance payable by a certified or cashier's check when delivered. All accounts not paid in ninety (90) days will be turned over to our lawyer for collecting. All charges for collecting will be charged to customer's account. Any dispute arising from the sale of nursery stock from Adcock Nursery shall be settled exclusively in the Chancery Court of Warren County, TN. The state of Tennessee shall be the forum for any and all litigation. A late payment charge of one and one-half percent (11/2%) per month (WHICH IS A TRUE ANNUAL RATE OF 18 PERCENT) will be made after thirty (30) days on unpaid balances.

WARRANTY:

We give no warranty, expressed or implied, as to the growth or productivity. WE ARE NOT RESPONSIBLE UNDER ANY CONDITIONS FOR THE LIVABILITY OR MERCHANTABILITY OF PLANTS THAT WE SHIP.

CLAIMS:

CLAIMS FOR ANY CAUSE MUST BE MADE PROMPTLY UPON RECEIPT OF STOCK. WE WILL NOT HONOR CLAIMS AFTER GOODS HAVE BEEN ACCEPTED, OR WHEN REPORT IS NOT MADE IN WRITING WITHIN FIVE (5) DAYS. AT NO TIME ARE WE LIABLE FOR MORE THAN THE ORIGINAL PURCHASE PRICE.

SHIPPING:

Customers are requested to give definite shipping instructions. All shipments travel at risk and expense of customer. Our responsibility ends when shipment leaves our nursery. Freight charges must be paid when shipment arrives. Customer is responsible for unloading truck. Truck drivers do not help unload trucks. Trucks should be unloaded in 2-3 hours.

CONDITIONS:

All orders accepted on condition they may be void if error in count or conditions beyond our control occurs (fire, frost, hail, etc.). We reserve the right to claim the tolerance in height, as set forth in the AAN Standard Guide, for slower growing trees and charge according to caliper. Prices are subject to change without notice. All prices are F.O.B. McMinnville, Tennessee.
